Welcome to LUX PHOTOGRAPHY AND VIDEOGRAPHY ("Lux," "we," "us," or "our"). By using our website, contacting us, booking services, or opting in to text messages, you agree to these Terms of Service.

If you do not agree, please do not use our website or services.

ABOUT OUR SERVICES
Lux provides photography, videography, content creation, and related creative services. Packages, pricing, timelines, and deliverables can vary based on the event, session, location, staffing needs, and final scope.

If you book with us, your signed agreement and invoice control the exact details for your project. These Terms support that agreement and also apply to website use and messaging.

WEBSITE USE
You may use our website for personal and business inquiry purposes only. You agree not to:
• Copy, download, or reuse our photos, videos, or written content without permission
• Attempt to hack, scrape, disrupt, or misuse the website
• Use the site for illegal activity

We may update, change, or remove content on our website at any time.

ELIGIBILITY (18+)
By using our website, submitting a form, booking services, or opting in to text messages, you confirm you are at least 18 years old, or you are using the website with the involvement and consent of a parent or legal guardian.

INTELLECTUAL PROPERTY
Everything on our website, including images, video, text, logos, and branding, belongs to Lux or is used with permission. You may not copy, reproduce, sell, publish, or distribute our content without written permission.

If you are a client, your usage rights for delivered photos and videos are outlined in your contract and/or our Privacy Policy. Lux retains copyright ownership unless agreed in writing.

INQUIRIES, PRICING, AND AVAILABILITY
Submitting an inquiry does not reserve a date. Dates are only held once:
• A signed agreement is received
• The required retainer/payment is received

Pricing and availability may change at any time until your booking is officially confirmed.

PAYMENTS AND RETAINERS
Unless stated otherwise in writing:
• A retainer is required to book and hold your date
• The remaining balance is due before or no later than the event date
• Late balances may delay delivery of galleries, films, or final files

All payments are subject to applicable taxes.

RESCHEDULING, CANCELLATIONS, AND NO SHOWS
Creative work is date-based. When you reserve a date, we often turn away other work.

Unless your signed agreement says otherwise:
• Retainers are non refundable
• Reschedules depend on availability
• If we can reschedule, any credit may apply to a new date within a reasonable time
• No shows may be treated as a cancellation

If a reschedule requires additional travel, staffing, or time, additional fees may apply.

CLIENT RESPONSIBILITIES
To help us deliver great work, you agree to:
• Provide accurate details, locations, and timelines
• Communicate venue rules, restrictions, and permits when required
• Obtain permissions for private property filming or photography when needed
• Share important shot requests ahead of time when possible
• Provide a day-of point of contact (planner, coordinator, or trusted person)

We are not responsible for missed moments caused by factors outside our control, including late starts, timeline changes, guest interference, restricted access, or venue limitations.

WEATHER, LIGHTING, AND UNCONTROLLABLE EVENTS
We cannot control weather, lighting, venue rules, or unexpected changes. You understand that these conditions may affect coverage and the final look of photos and video. We will always do our best to adapt and still create strong work.

DELIVERY TIMELINES
Delivery timing depends on season, scope, and workload. Your contract or invoice may list an expected delivery window. If no window is listed, we will provide a reasonable estimate.

Delays can happen due to illness, emergencies, hardware issues, or circumstances beyond our control. If that happens, we will communicate with you as soon as reasonably possible.

EDITING STYLE, REVISIONS, AND CHANGE REQUESTS
Photography and videography editing is creative work. By booking Lux, you are hiring our style and storytelling approach.

If your package includes revisions, they are limited to reasonable adjustments. Major re-edits, additional versions, or changes outside your original scope may require an additional fee.

ARCHIVING AND STORAGE
We keep project files for a period of time for business purposes, but we do not promise permanent storage unless you purchase an archival or extended storage option in writing.

We strongly recommend you download and back up your final gallery, video, or files as soon as they are delivered.

THIRD PARTY SERVICES
We may use third party platforms to deliver galleries, videos, invoices, scheduling, communication, analytics, or advertising. We are not responsible for outages, downtime, or errors caused by those third party platforms.

LIMITATION OF LIABILITY
To the fullest extent allowed by law:
• Lux is not liable for indirect, incidental, special, or consequential damages
• Our total liability for any claim is limited to the amount you paid Lux for the specific service giving rise to the claim

If a rare technical failure occurs (camera malfunction, file corruption, data loss, etc.), our responsibility is limited to reasonable efforts to fix the issue and, if needed, a refund up to the amount paid for the affected services, as allowed by your agreement.

INDEMNIFICATION
You agree to protect and hold Lux harmless from claims, damages, or expenses that arise from:
• Your breach of these Terms
• Your negligence or misconduct
• Your failure to obtain permissions, permits, or releases when required

PRIVACY
Your use of our website and services is also governed by our Privacy Policy.

TEXT MESSAGING TERMS (SMS)
Texts are only sent to customers who have opted in through our website forms or by directly requesting text communication.

Transactional Messages (Non Promotional)
If you choose to opt in, you agree to receive transactional text messages from LUX PHOTOGRAPHY AND VIDEOGRAPHY at the phone number you provided. Transactional messages may include appointment reminders, scheduling updates, booking updates, and other service related notifications.
